504 Section 504 of the Rehabilitation Act of 1973 is a civil rights statute which provides that: "No otherwise qualified individual with disabilities in the United States . . . shall, solely by reason of his/her disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance or activity conducted by any executive agency or by the United States Postal Service." 29 U.S.C. 794.

 ADA - Americans with Disabilities Act

 Amicus Curiae - friend of the court.

 APE - Adaptive Physical Education

Appeal - a process whereby a superior court or tribunal reviews the records, proceedings, and judgment of a lower court to determine if errors of law were made by the lower court or tribunal.

ARC- Association for Retarded Citizens

ARD-Admission, Review & Dismissal

ARP - Advisory Review Panel

Assistive Technology Device - equipment used to maintain or improve the capabilities of a child with a disability.

AT - Assistive Technology

Case Law - judicial opinions issued by a court.

CEC - Council for Exceptional Children

 
Cert. Denied - an abbreviation indicating that a superior court – usually the United States Supreme Court – has declined 
to review a decision of a lower court.
 
Certiorari - a discretionary writ giving an appellate court jurisdiction to review the decision of a lower court.
 
CIC - Clearinghouse/Information Center ERIC Clearing House on Disabilities and Gifted Education
 
Class Action - a civil action filed in a court on behalf of a named plaintiff and on behalf of other individuals similarly situated.
 
Common Law - law developed over time by usage and custom.
 
Community Setting: This is a setting outside of school property where I.E.P. goals and objectives are the focus of 
instruction.
 
Complaint - a legal document filed in court commencing a case. The complaint outlines a plaintiff’s claim against a 
defendant.
 
DCFS - Department of Children and Family Services 

DD - Developmentally Delayed

Dicta - a term referring to any language in a court’s decision that is not essential to the disposition of the case or 
to the reasoning of the court.
 
Disability - under the ADA, an impairment that substantially affects one or more major life activities, record of 
having such impairment, or being regarded as having such an impairment.
 
Discovery - the pre-trial process by which parties to a lawsuit exchange information with the other party.
 
DMH/DD - Department of Mental Health/Developmental Disabilities

DOE -Department of Education
 
Due Process Hearing - an administrative hearing before an impartial hearing officer.
 
Due Process of Law - a right to have any law applied reasonably and with sufficient safeguards, such as hearings 
and notice, to ensure that an individual is dealt with fairly. Due process is guaranteed pursuant to the Fifth Amendment 
and the Fourteenth Amendment to the United States Constitution.
EAHCA - Education for All Handicapped Children Act. In 1990, the EAHCA was renamed the Individuals with Disabilities 
Education Act (IDEA).
 
Early Intervention - special education and related services pursuant to the IDEA provided to children under the age of 5.

ECE - Early Childhood Education

EHA- Education for all Handicapped Act, Public Law 94-142

EI - early intervention.

Equal Protection of Law - a right not to be discriminated against for any unjustifiable reason, such as because of race
or disability. Equal protection is guaranteed pursuant to the Fourteenth Amendment to the United States Constitution.

ESY - extended school year services.

Expert Witness - a person called as a witness to testify because he/she has a recognized competence and expertise in
a subject area.

FAPE - Free & Appropriate Public Education

FERPA - Family Educational Rights and Privacy Act. FERPA deals with confidentiality and access to student records.

Full Inclusion: Full inclusion means that all students, regardless of handicapping condition or severity, will be in a
regular classroom/program full time. All services must be taken to the child in that setting.

FTE- Full Time Equivilancy

General Education Setting: This setting includes students without disabilities whose primary instruction is presented
by a teacher who is endorsed in general education.

HCPA - Handicapped Children’s Protection Act of 1986. HCPA was an amendment to the EAHCA allowing
reimbursement of attorney’s fees and costs to parents who succeed on the merits of a claim pursuant to the statute.

IDEA: Individuals with Disabilities Education Act

IDELR - Individuals with Disabilities Law Reporter.

IEP: Individualized Education Program   Individualized Education Program (IEP) is a written agreement between the
parents and the school about what the child needs and what will be done to address those needs. In accordance with
the Individuals with Disabilities Education Act (IDEA, formerly PL 94-142), IEPs must be drawn up by the educational
team for the exceptional child and must include the following:

1. The student's present levels of academic performance.
2.  Annual goals for the student.
3.  Short- term instructional objectives related to the annual goals.
4.  The special education and related services that will be provided and the extent to which the child will participate in
regular education programs.
5. Plans for starting the services and the anticipated duration of services.
6. Appropriate plans for evaluating, at least annually, whether the goals and objectives are being achieved.
7. Transition planning for older students.

 IFSP - Individual Family Service Plan. Early Intervention's IEP, which also includes how the services will be paid for.

Inclusion: Inclusion is a term, which expresses commitment to educate each child, to the maximum extent appropriate,
in the school and classroom he or she would otherwise attend. It involves bringing the support services to the child (rather than moving the child to the services) and requires only that the child will benefit from being in the class (rather than
having to keep up with the other students). Proponents of inclusion generally favor newer forms of education service delivery.

Injunctive Relief - a court-ordered remedy forbidding or requiring some action by the defendant

Integrated Setting: This is a setting composed of students with and without disabilities sharing meaningful educational experiences.  Primary instruction may be presented by a special education endorsed teacher and general education teacher (co-teachers) or a dual certified teacher.

Least Restrictive Environment: (A) IN GENERAL - "To the maximum extent appropriate, children with disabilities, including children in public or private institutions or other care facilities, are educated with children who are not disabled, and special classes, separate schooling, or other removal of children with disabilities from the regular educational environment occurs only when the nature or severity of the disability of a child is such that education in regular classes
with the use of supplementary aids and services cannot be achieved satisfactorily." {IDEA}

LRE - Least Restrictive Environment

Mainstreaming: Generally, mainstreaming has been used to refer to the selective placement of special education students in one or more "regular" education classes. Proponents of mainstreaming generally assume that a student must "earn" his or her opportunity to be placed in regular classes by demonstrating an ability to "keep up" with the work assigned by the regular classroom teacher. This concept is closely linked to traditional forms of special education service delivery.

NICHCY- National Information Center for Children and Youth with Disabilities

OHI - other health impaired - a category of eligibility pursuant to the IDEA.

OT - Occupational Therapy (or Therapist).

PET - Pupil Evaluation Team. This is the group that makes the final decisions about programming and placement. You are the most important member of this team, sometimes called a PPT - Pupil Placement (or Planning) Team.

- Profoundly Mentally Handicapped

PREP - Pre-Primary Education Program

PT - Physical Therapy/Therapist

PTA - Physical Therapist Assistant

Reasonable Accommodation - an adoption of a facility or program for a child with a disability that can be accomplished
without undue administrative or financial burden.

Related Services: Related Services means transportation and such developmental, corrective, and other supportive
services as are required to assist a child with a disability to benefit from special education. These services include
speech-language therapy, occupational therapy, physical therapy, vision services, hearing services, assistive technology
services, vocational assessments/training, recreation, and transition planning to prepare students for adult life.

Resource Room - a special education placement that is provided in conjunction with or as a supplement to a child’s 
regular education program. 

SLP - Speech-language Pathologist.

Special Education Setting: This setting is primarily composed of students with disabilities with primary instruction presented by a teacher who is licensed with a special education endorsement.

Stay Put Rule" - Prevents change of placement without IEP placement without IEP change

TASH - The Association for Severe Handicaps 

Transition Services - A component of the IDEA to facilitate movement from school to the workplace or high education.
